Terms of Service

1. Agreement to Terms

By downloading, installing, or using the Wine Uni mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you (“User”, “you”) and the operator of Wine Uni (“we”, “us”, “our”), reachable at support@thewineuni.com.

We reserve the right to update these Terms at any time. If we make material changes — including changes to pricing, your rights, or how we handle your data — we will notify you at least 30 days in advance via the App or the email address on your account. If you do not agree to the revised Terms, your remedy is to cancel any active subscription and delete your account before the changes take effect. Continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.

2. Description of Service

Wine Uni is a wine education application designed to help users prepare for WSET (Wine & Spirit Education Trust) certifications and broaden their general wine knowledge. The App provides:

• Interactive multiple-choice quizzes across WSET Level 2, Level 3, Diploma, and General Wine Knowledge
• Practice, Diagnostic, and Focus Mode quiz sessions
• Progress tracking, readiness assessments, and performance analytics
• Streak-based engagement and study scheduling tools

The App is available on iOS devices running iOS 17.4 or later.

3. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you may not use the App.

The App references and discusses alcoholic beverages in an educational context. It does not facilitate the sale or purchase of alcohol.

The App is rated 17+ on the Apple App Store, which is Apple’s highest age rating tier. While the App Store permits downloads at age 17, you must be 18 or older to create an account and use the App under these Terms.

4. User Accounts

4.1 Account Creation

You may use limited features as a guest (up to 30 practice questions). To access full features, you must create an account using Sign in with Apple or Sign in with Google.

4.2 Account Responsibility

You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately at support@thewineuni.com if you suspect unauthorised access.

4.3 Accurate Information

You agree to provide accurate and up-to-date information during account creation and to keep it current.

4.4 One Account Per Person

Each account is for individual use only. You may not share your account credentials with others.

4.5 Account Deletion

You may delete your account at any time from within the App. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

5. Subscriptions and Payments

5.1 Free Tier

Guest users may access up to 30 quiz questions at no cost. Registered free accounts have access to a limited set of features.

5.2 Pro Subscription

Premium features — including Focus Mode, full Progress analytics, Readiness Dashboard, and unlimited quiz access — require a paid “Pro” subscription, available as:

• Pro Monthly: billed monthly
• Pro Annual: billed annually

Prices are displayed in the App before purchase and may vary by region.

5.3 Free Trial

Where offered, eligible new users may receive a 7-day free trial of the Pro subscription. Each user is eligible for one free trial only; trial eligibility is tracked and non-transferable.

Automatic renewal disclosure (required by law in many jurisdictions):

• No charge during trial. You will not be billed during the 7-day free trial period.
• Auto-conversion. Unless you cancel at least 24 hours before the trial ends, your trial will automatically convert to a paid Pro subscription and your payment method on file with Apple will be charged at the then-current subscription price displayed in the App at the time you activated the trial.
• Recurring charges. After conversion, your subscription renews automatically at the end of each billing period (monthly or annual, as selected) at the same price, until you cancel.
• How to cancel before being charged. Open the Settings app on your device → tap your name → Subscriptions → Wine Uni → Cancel Free Trial. You must cancel at least 24 hours before the trial ends to avoid being charged.
• Price. The applicable price is shown in the App before you activate the trial. Prices may vary by country and are inclusive of applicable taxes where required by law.

By activating a free trial, you acknowledge that you have read and understood these automatic renewal terms.

5.4 Billing

All payments are processed through Apple’s App Store and are subject to Apple’s payment terms. We do not handle or store your payment information.

5.5 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Renewal charges are applied within 24 hours of the end of each period.

5.6 Cancellation

You may cancel your subscription at any time through your Apple ID account settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused periods unless required by applicable law.

5.7 Refunds

Refund requests are handled exclusively by Apple in accordance with their refund policy. We have no ability to grant refunds directly.

5.8 EU Right of Withdrawal

If you are a consumer in the European Economic Area, you have a statutory 14-day right of withdrawal on digital content purchases under the EU Consumer Rights Directive. However, by activating a subscription or free trial, you expressly request immediate delivery of the digital content and acknowledge that you waive your right of withdrawal once access to the content has commenced. If you wish to exercise a withdrawal right before content delivery begins, contact Apple directly through your App Store account.

5.9 Price Changes

We reserve the right to change subscription prices. We will give you at least 30 days’ advance notice of price changes via the App or email. Continued use after the change constitutes acceptance.

6. Intellectual Property

6.1 Our Content

All content in the App — including but not limited to quiz questions, answers, explanations, text, graphics, logos, and software — is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, create derivative works from, or commercially exploit any part of the App without our prior written consent.

6.2 WSET Reference

References to WSET qualifications and syllabi are for educational purposes. Wine Uni is an independent study tool and is not affiliated with, endorsed by, or officially associated with WSET.

6.3 User Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial educational purposes, subject to these Terms.

6.4 Feedback

If you provide feedback or suggestions about the App, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use that feedback for any purpose without obligation to you.

7. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable regulations
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Attempt to gain unauthorised access to any part of the App or its backend infrastructure
• Scrape, harvest, or extract quiz content or data in bulk
• Misrepresent your identity or impersonate another person
• Use automated tools, bots, or scripts to interact with the App
• Circumvent subscription restrictions, trial limits, or access controls
• Interfere with the security, integrity, or performance of the App or its services
• Share, sell, or sublicense your account or subscription access

Violation of these prohibitions may result in immediate account termination.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be error-free, uninterrupted, or available at all times
• Quiz content is complete, accurate, or up to date with current WSET syllabi
• Your use of the App will result in passing any examination

Statutory rights: If you are a consumer in a jurisdiction where implied warranties or statutory guarantees cannot be excluded by contract — including New Zealand (Consumer Guarantees Act 1993), Australia (Australian Consumer Law), the United Kingdom (Consumer Rights Act 2015), or the European Economic Area — the disclaimers above apply only to the fullest extent permitted by the mandatory laws of your jurisdiction. Nothing in this section limits or excludes any rights you have under applicable consumer protection legislation that cannot be waived by contract.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOST PROFITS, OR LOSS OF GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE PAID US NOTHING IN THAT PERIOD, OUR TOTAL LIABILITY TO YOU IS ZERO TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Wine Uni and its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the App in violation of these Terms
• Your violation of any applicable law or regulation
• Your infringement of any third-party rights
• Any content or information you submit through the App

We reserve the right to assume exclusive control of any matter subject to indemnification by you, and you agree to cooperate with our defence of such claims.

11. Force Majeure

We will not be liable for any failure or delay in performance of our obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, civil unrest, government action, internet or telecommunications failures, or failure of third-party service providers (including Apple, Supabase, or Google).

12. Third-Party Services

The App integrates with third-party services including Supabase (backend infrastructure), Apple and Google (authentication), and TelemetryDeck (analytics). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

13. Availability and Modifications

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the service. We will endeavour to provide advance notice of significant changes where reasonably practicable.

14. Termination

14.1 By You

You may stop using the App and delete your account at any time.

14.2 By Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or where required by law.

We may also terminate accounts that have been inactive for more than 24 consecutive months. Before doing so, we will send at least 30 days’ written notice to the email address on your account. Active paid subscriptions will not be terminated for inactivity; this provision applies only to accounts with no active subscription and no recent usage.

14.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.

15. Governing Law and Disputes

15.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at support@thewineuni.com and give us 30 days to attempt to resolve the dispute informally. We will make reasonable efforts to resolve your concern promptly. This informal step is a condition precedent to any formal claim.

15.2 Governing Law

These Terms are governed by the laws of New Zealand. Subject to Section 15.1 and any mandatory consumer protection laws in your jurisdiction, any unresolved dispute shall be subject to the exclusive jurisdiction of the courts of New Zealand.

15.3 EU and Other Consumer Rights

If you are a consumer resident in the European Union, mandatory consumer protection laws in your country of residence may apply in addition to these Terms, and you may make use of the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

If you are a consumer in any other jurisdiction, nothing in these Terms limits any rights you may have under local mandatory consumer protection law.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us concerning the App and supersede all prior agreements.
